1. Purpose

This Agreement formalizes the sale of the Item and the completion of a notarized transfer of ownership. Upon notarization, the Platform will release payment to the Seller in accordance with Section 5.

2. Buyer Responsibilities

1. Review all listing information, ownership documentation, and pricing before purchase.
2. Provide accurate personal information for notarized transfer documents.
3. Complete payment through the Platform, which is held in escrow until notarization is finalized.
4. Attend or authorize attendance at the notary appointment to execute transfer documents.
5. After notarization, deliver notarized transfer documents to the facility or organization if required.
6. Pay any applicable transfer fees directly to the facility or organization.
7. Understand that all sales are final upon notarization.

3. Seller Responsibilities

1. Provide accurate listing information, valid ownership documentation, and location details.
2. Complete notarized transfer documents promptly.
3. Respond to Buyer inquiries in a timely manner.
4. Comply with all applicable laws for the sale and transfer.
5. Ensure the Item is free of claims or encumbrances.
6. Understand that payment is released immediately after notarization, regardless of the Buyer’s post-notarization requirements.

4. Platform Role (Us After Death)

• The Platform facilitates payment, escrow, document generation, and recordkeeping.
• Release of Funds (Option 1): Payment is released to the Seller once notarization is completed and verified. Buyer post-notarization responsibilities do not delay Seller payout.
• The Platform does not deliver documents to any facility or pay transfer fees on behalf of the Buyer.
• The Platform does not communicate with facilities, cemeteries, or memorial parks to finalize post-notarization updates.

5. Payment and Fees

1. Buyer payments are made through the Platform.
2. Funds remain in escrow until notarization is fully completed.
3. Upon notarization, payment is released to the Seller minus applicable Platform fees.
4. Off-platform payments are strictly prohibited.

6. Notarization and Transfer

1. Buyer and Seller must attend a notary appointment to execute transfer documents.
2. Notarized documents serve as the final and binding proof of ownership transfer.
3. Ownership is legally transferred upon notarization, regardless of any remaining Buyer facility-related steps.

7. Post-Notarization Buyer Responsibilities

1. Deliver notarized documents to the facility or organization as required.
2. Pay any facility-required transfer fees directly.
3. Follow the facility’s instructions for updating official ownership records.

These responsibilities occur after ownership has transferred and do not affect Seller payout.

8. Finality of Sale

1. All sales are final upon notarization.
2. Refunds and chargebacks are not permitted after notarization.
3. The Platform’s role ends once notarization is completed and Seller payment is released.

9. Representations and Warranties

• Seller warrants legal ownership and authority to sell the Item.
• Buyer warrants legal capacity to purchase the Item and accuracy of provided information.

10. Dispute Resolution

• This Agreement is governed by the laws of the state where the Platform is incorporated.
• Disputes may be resolved through binding arbitration.
• Parties waive the right to class-action claims involving the Platform.
