Us After Death (“Company,” “we,” “our,” or “us”) operates an online marketplace connecting individuals who wish to buy and sell burial plots, columbariums, memorial spaces, and related items. We facilitate payment processing, recordkeeping, and notarized transfers but are not brokers, real estate agents, or funeral service providers. We do not guarantee the condition, location, or suitability of any memorial space or item. Us After Death is a neutral technology platform that facilitates introductions, documentation workflows, escrow coordination, and notarization between independent buyers and sellers. The Company does not sell burial rights and does not participate in price negotiation or transfer approval decisions.
By using our platform, Buyers, Sellers, and Vendors agree to comply with these Terms of Service.
- We act as a platform, not a broker, agent, or legal representative.
- Users are responsible for complying with all applicable local, state, and federal laws regarding the sale, transfer, and purchase of memorial spaces or items.
No Legal, Real Estate, or Funeral Advice
- Us After Death does not provide legal, real estate, cemetery, funeral, or tax advice.
- Users are encouraged to consult qualified professionals regarding their specific
circumstances prior to completing a transaction.
- Non-Exclusivity: The introductions and marketplace services provided by Us After Death are on a non-exclusive basis. The Company reserves the right to provide similar leads and services to other vendors, partners, and competitors.
2.1 State-Specific Laws & Cemetery Regulations
- Burial plots, mausoleum crypts, columbarium niches, and memorial spaces are subject to
state, local, and facility-specific laws and regulations, which may vary by jurisdiction.
- Us After Death does not determine or warrant whether a listing complies with any
particular state or local requirement.
- Sellers are solely responsible for ensuring that their listings, ownership rights,
pricing, transferability, and disclosures comply with the laws of the state and facility
in which the memorial space is located.
- Buyers acknowledge that certain transfers may require additional approvals,
documentation, or fees imposed by cemeteries or governing authorities.
3. Buyer Responsibilities
- Due Diligence: Review all listing details, ownership documentation, and pricing before purchase.
- Accuracy: Provide accurate personal information when creating an account and completing forms.
- Compliance: Follow all applicable laws regarding ownership and purchase.
- Escrow Understanding: Payments remain in escrow until notarized transfer documents are signed.
- Timely Communication: Respond promptly to messages from sellers and the platform.
- Final Decision: All sales are final and non-refundable once notarization is completed.
- Platform Use: Communicate only through the platform; bypassing escrow or conducting off-platform transactions is prohibited.
- Post-Notarization Requirements: Buyers are responsible for delivering the notarized document to the facility and/or additional organizations and paying any required transfer fees directly.
Listing and Product Reviews
- Submission: Users may submit reviews for purchased products or services on the Us After Death platform. Reviews must be accurate, honest, and based on the reviewer’s own experience.
- Content Guidelines: Reviews must not contain offensive, discriminatory, defamatory, or false statements. Users may not include personal contact information or links to external sites.
- Moderation: Us After Death reserves the right to monitor, edit, or remove any review that violates these guidelines or the platform’s policies.
- No Compensation: Users are not entitled to compensation for submitting reviews. Reviews may be displayed publicly on the platform and used for promotional purposes.
- Accountability: Users are responsible for the content of their reviews. Us After Death is not liable for disputes arising from user-submitted reviews.
- Reporting: Users may report reviews they believe violate the guidelines. Us After Death will review reported content and take action as necessary.
4. Seller Responsibilities
- Accurate Listings: Provide complete and accurate information, including ownership documents, location, and details.
- Proof of Ownership: Must submit valid ownership documents before publishing a listing.
- Notary Documents: Complete all transfer documents for notarization promptly.
- Pricing: Ensure fair and accurate pricing. Top-performing listings often price memorial spaces ~20% below retail.
- Communication & Safety: Sellers must respond to all buyer inquiries within 24–72 hours. Failure to respond may result in the buyer being redirected to alternative listings or vendors. For the safety of both buyers and sellers, all communication must occur exclusively within the Us After Death Marketplace platform. Requests for off-platform contact, including phone calls, emails, or onsite visits, are strictly prohibited. Sellers may share photos and videos of the premises only within the platform to facilitate transactions and maintain transparency.
- Compliance: Follow all applicable laws related to selling memorial spaces or items.
- Escrow & Payment: Acknowledge that funds are held in escrow until notarization is completed.
- Final Sales: All sales are final once notarized transfer is executed.
- Prohibited Actions: No off-platform sales, fraudulent or misleading activities. Violations may result in fines up to $10,000 and/or account suspension.
- Ongoing Updates: Update listing status every 7 days to ensure accuracy.
- Lead Definition: A “Lead” is defined as a unique individual contact identified by a specific email address. For Partners on a lead-based plan, the Company will only charge for a Lead once per calendar month, regardless of the number of inquiries made by that same individual during that period.
- Lead Rejection: Premier Partners may reject a Lead within five (5) business days of delivery if the Lead contains invalid contact information (e.g., disconnected phone number or bounced email) or is a duplicate of a Lead already received within the previous thirty (30) days. Rejections must be submitted in writing to support@usafterdeath.com.
5. Listing Verification
- All listings are reviewed before publication to verify ownership, accuracy, and compliance.
- Listings cannot be published without valid ownership documentation.
- Us After Death reserves the right to reject, remove, or suspend listings if fraudulent, incomplete, or non-compliant.
6. Payment Process
- All buyer payments are made directly to Us After Death via Stripe, PayPal, or an accepted credit card.
- Funds are held in escrow until the notarized transfer of ownership is complete. All buyer payments are processed through Us After Death’s approved third-party payment
processors and escrow partners. Us After Death does not commingle funds and does not act as a licensed escrow agent.
- Seller Accountability: If a seller refuses to complete a sale after a buyer has agreed to the listed price and placed payment into escrow, the seller’s account may be suspended pending review. Repeated or unjustified refusals may result in permanent removal from the platform.
- Payments cannot be completed outside the platform; Us After Death is not responsible for off-platform transactions.
- Release of Funds to Seller: Once the Buyer and Seller complete the notary appointment and the notarized transfer documents are verified, Us After Death will release payment to the Seller, minus applicable fees.
- Post-notarization Buyer responsibilities (such as delivering documents to a facility or paying transfer fees) do NOT delay Seller payout.
- Sellers/Vendors are responsible for any applicable service or platform fees, which are automatically deducted from the escrowed funds prior to payout.
- Notarized transfer documentation and signed Final Sale Agreements serve as conclusive proof that the transaction is complete.
- Buyers agree not to file chargebacks or refund claims after notarization.
7. Notarized Transfer Requirement
- Buyer and Seller must complete a notarized transfer of ownership for all transactions.
- Funds remain in escrow until notarized documentation is submitted and verified by Us After Death.
- Upon verification of notarized transfer documents, the transaction is deemed complete
for Marketplace purposes. Legal recognition of ownership remains subject to the policies
and records of the applicable facility or governing authority.
- Buyer’s post-notarization obligations (such as delivering documents or paying facility-based fees) are independent of the Seller’s payout and handled directly between the Buyer and the facility.
- Notary appointments are provided at no cost, and the necessary documents are prepared in advance.
8. Gift Cards
- Gift cards may be emailed or saved for later use.
- All gift card purchases are final and non-refundable.
- Gift cards can only be redeemed on the Us After Death platform and expire three years after purchase.
9. Prohibited Activities
- Off-platform sales or payments result in fines and possible account suspension.
- Misrepresentation or fraud is prohibited.
- Sharing private platform information or user data is forbidden.
- Platform disruption, hacking, or introducing malicious software is prohibited.
- Non-Resale of Data: Leads and introductions provided by the Company are for the Vendor’s internal use only. Vendors are strictly prohibited from selling, sharing, or distributing Lead data to any third party or affiliate without prior written consent from Us After Death.
- All users must comply with applicable laws at all times.
10. Intellectual Property
- All platform content, including text, images, logos, software, and designs, is owned by Us After Death or its licensors.
- Unauthorized use, copying, or distribution is prohibited and may result in legal action.
11. Disputes, Chargebacks & Liability
- Notarized transfer documentation and signed Final Sale Agreements serve as conclusive evidence of transaction completion.
- Buyers agree not to file chargebacks or request refunds after notarization.
- No Guarantee of Conversion: Us After Death provides introductions and data only. The Company does not guarantee that a Lead will convert into a sale, donation, or any other specific outcome. The Company is not responsible for the eligibility or intent of any Lead provided.
- If a buyer submits payment into escrow but later refuses to proceed with the notarization or final transfer, a 7% service inconvenience fee will be deducted from the escrowed amount to cover administrative and processing costs. The remaining balance will be refunded to the buyer.
- Us After Death does not provide title searches, ownership guarantees, or legal validation
of burial rights. Sellers alone represent that they possess the legal authority to transfer
the listed memorial space.
- The Company is not liable for:
- Title, ownership history, or legal restrictions
- Misrepresentations by Buyers or Sellers
- Damages, disputes, or losses after notarized transfer
12. Pre-Approved Vendors
- Vendors must complete the pre-approval process and receive a unique verification number.
- Pre-approval is non-transferable and requires compliance with laws and platform policies.
- Vendors are responsible for their actions, products, and services; Us After Death is not liable for vendor disputes.
- Us After Death may suspend or revoke pre-approved status for violations.
13. Platform Use & Communication
- Buyers and Sellers must communicate exclusively through the Us After Death platform.
- All messages exchanged on the platform are monitored and moderated to ensure compliance with these Terms and Conditions and to maintain the safety and integrity of all users.
- Harassment, threats, abusive language, or inappropriate behavior toward other users or Us After Death staff may result in immediate account suspension or termination.
- Respond promptly: Buyers and Sellers are expected to reply to messages within one business day; platform support will respond within two business days.
- Communication that includes off-platform contact details (such as personal emails, phone numbers, or social media handles) is prohibited to protect user privacy and maintain secure transactions.
- Sellers must respond to all buyer inquiries within 24–72 hours. Failure to respond may result in the buyer being redirected to alternative listings or vendors.
- Us After Death reserves the right to review, restrict, or remove any message that violates platform guidelines or applicable laws.
- All correspondence between users and Admin/Support must remain professional and respectful; repeated violations may result in permanent removal from the platform.
- For the safety of both buyers and sellers, all communication must occur exclusively within the Us After Death Marketplace platform. Requests for off-platform contact, including phone calls, emails, or onsite visits, are strictly prohibited.
- Sellers may share photos and videos of the premises only within the platform to facilitate transactions and maintain transparency.
14. Buyer/Customer Post-Notarization Responsibilities
After a purchase is notarized and ownership is officially transferred, Buyers/Customers may be required to complete two additional responsibilities directly with the facility or organization:
1. Delivery of the Notarized Document
Many facilities require the Buyer/Customer to provide a copy of the notarized transfer document before updating their internal ownership records.
2. Payment of Transfer Fees (if required)
Some cemeteries, memorial parks, or columbariums charge transfer fees. These fees are not paid through Us After Death and must be handled directly by the Buyer/Customer.
Buyer Responsibility for Confirming Requirements
It is the Buyer/Customer’s responsibility to ensure that they have the necessary steps, instructions, and contact information before escrow closes. Buyers should obtain this information from the Seller or by contacting the facility or organization directly.
Us After Death does NOT communicate with facilities
- Deliver notarized documents to any facility
- Pay or process transfer fees on behalf of Buyers
- Communicate with cemeteries, organizations, or memorial parks to complete the transfer
- Handle or resolve any post-notarization requirements
All post-notarization confirmation steps must be completed by the Buyer/Customer directly with the facility or organization. Us After Death’s role ends once the purchase is notarized and ownership is transferred.
15. Termination
- Us After Death may suspend or terminate accounts for policy violations, illegal activity, or suspected fraud.
- Users may close accounts by contacting support.
- Termination does not relieve obligations for in-process transactions, fines, or legal responsibilities.
16. Governing Law
- Terms are governed by the laws of the state where Us After Death is incorporated.
- Disputes will be resolved through binding arbitration where permitted.
- Users waive the right to class-action lawsuits against the platform.
17. Updates to Terms
- Terms may be updated at any time to reflect policy, law, or platform changes.
- Users will be notified via email or platform notification.
- Continued use constitutes acceptance of updated terms.

20. Listing Removal, Modifications, and Display Concerns
Companies listed in the Us After Death directory who wish to request a modification, correction, or removal of their listing must follow the procedures outlined below:
20.1 Request Process
All requests for listing edits, corrections, or deletions must be submitted in writing to:
support@usafterdeath.com
Requests should include:
- Company name
- Verification/approval number (if applicable)
- Authorized representative’s name and contact information
- Specific details of the requested change
- Any supporting documentation (if ownership or accuracy is in question)
20.2 Processing Time
Please allow up to 30 days for Us After Death to review, process, and complete the requested modification or removal.
Processing times may vary depending on:
- Verification requirements
- The volume of requests
- Whether ownership documentation or legal confirmation is required
Urgent requests will be reviewed as quickly as possible, but no turnaround times are guaranteed.
20.3 Accuracy & Verification
Us After Death may require additional information or documentation to:
- Confirm the request is being made by an authorized representative
- Validate the accuracy of the correction
- Ensure the request does not conflict with verified ownership or legal records
Failure to provide documentation may delay processing or result in rejection of the request.
20.4 Limitations & Platform Rights
Us After Death reserves the right to:
- Decline modification or removal requests that conflict with verified ownership records
- Remove or edit listings that contain inaccurate, misleading, or non-compliant information
- Suspend or delete listings involved in disputes, legal concerns, or policy violations
- Determine final formatting, structure, and layout of all listings to maintain consistency and platform standards
Companies acknowledge that:
- Display format, layout, and placement within the directory are managed solely by Us After Death
- A listing’s visibility or ranking within the directory is not guaranteed
- Us After Death is not responsible for business impacts related to visibility, placement, or removal
20.5 No Guaranteed Outcomes
21. Full Payment Requirement (No Down Payments Allowed)
To maintain the integrity, legality, and safety of all transactions on the Us After Death Marketplace, all buyers and sellers must comply with the following payment requirements for burial plots, niches, crypts, and other memorial property:
21.1 Prohibition on Down Payments and Partial Payments
- Buyers and sellers may not request, offer, or accept any down payment, deposit, partial payment, or installment arrangement outside of the approved Marketplace checkout.
- Any attempt to bypass Marketplace checkout for partial payment may result in suspension or permanent removal from the platform.
21.2 Full Payment Required
- All transactions must be completed in full through the Marketplace checkout system before notarized transfers of ownership can occur.
- Buyers may use approved Buy Now Pay Later providers (such as Affirm, Klarna, Afterpay, or PayPal Later) at checkout; the seller will receive the full amount upfront while the buyer pays installments privately.
- No transaction is considered complete until full payment is verified and notarized transfer documentation is submitted and confirmed by Us After Death.
21.3 Seller Responsibilities
- Sellers may not list items as "down payment only" or request partial payments outside the Marketplace.
- Sellers must ensure accurate pricing and full payment requirements are clearly stated in the listing description.
- Sellers must communicate all payment instructions through the Marketplace platform only.
21.4 Buyer Responsibilities
- Buyers may not negotiate or request partial payments directly with the seller.
- Buyers must pay the full listing price through Marketplace checkout or approved BNPL options only.
- Buyers are prohibited from sending any off-platform payments to the seller.
21.5 Enforcement
- Violations of this section may result in canceled transactions, removal of listings, temporary suspension, or permanent account termination.
- Us After Death reserves the right to review any suspicious activity related to payments and take appropriate action to protect buyers, sellers, and the platform.
This policy ensures that all transactions are secure, fully documented, legally compliant, and ready for cemetery-approved notarized transfer.
22. Verified Seller Plan
The Verified Seller Plan applies to all users listing burial plots, niches, crypts, or related memorial items on the Us After Death Marketplace. This includes Verified Cemetery & Site Owners, Verified Individual Representatives, and Verified Professional Brokers.
22.1 No Monthly Membership Fees
Verified Sellers are not required to pay monthly dues or subscription fees to list items on the Marketplace. Listings may be created, updated, and managed at no ongoing cost.
22.2 Service Fee Structure (18%)
Verified Sellers agree to a standard 18% service fee applied to the total sale price of any item sold through the Us After Death platform. This fee is automatically deducted from escrowed funds before payout. For Professional Brokers, additional commission splits may be applied per the Broker Master Agreement.
22.3 Payment After Notarization
Verified Sellers receive payout only after notarized transfer documents are completed, submitted, and verified by Us After Death.
Funds are released immediately upon verification, minus the 18% service fee.
Buyer post-notarization obligations (such as transfer fees, facility updates, or document delivery) do not delay seller payout.
22.4 Compliance Requirements
Verified Sellers must comply with all policies outlined in these Terms, including the rules described in Sections 4, 6, and 7,
as well as all communication and payment requirements.
Failure to comply may result in listing removal, fines, suspension, or removal from the Verified Seller Plan.
23. Minimum Checkout Requirement
To maintain compliance, transaction integrity, and platform security, the Us After Death Marketplace enforces a minimum purchase requirement for all checkout transactions.
23.1 Required Minimum Purchase Amount
- All customers must meet a minimum checkout amount of $500 to complete a purchase on the Marketplace.
- This requirement applies to all listings, including paid listings, low-priced listings, and listings marked as free.
- Even if a seller offers a “free” listing or low-value item, the system will not allow checkout to proceed unless the total transaction meets the $500 minimum.
23.2 Purpose of the Minimum Checkout Requirement
- Ensures platform, processing, notary, and administrative workflows remain efficient and properly funded.
- Prevents fraudulent low-value transactions and maintains legal and operational standards for memorial property transfers.
- Supports verification, documentation handling, and secure transfer processes required for cemetery and facility acceptance.
23.3 Non-Compliance
- Transactions below $500 cannot be processed or submitted.
- Attempts to bypass this policy may result in suspension, listing removal, or account review.
24. Escrow & Incomplete Transactions
- In the event a Vendor or Seller is unable or unwilling to complete a sale after the Buyer has submitted payment to escrow, a 7% service/inconvenience fee will be retained from the escrowed amount to cover administrative, processing, and operational costs.
- The remaining balance of the escrowed funds will be refunded to the Buyer.
- The Buyer may request to transfer the escrowed funds to another Vendor or Seller within 30 days of the original transaction.
- To initiate a transfer, the Buyer must contact Us After Death Support at support@usafterdeath.com with the details of the new Vendor or Seller. Transfers cannot be completed without platform approval.
- Escrow transfers are subject to verification of the new Vendor/Seller’s pre-approval status and compliance with all platform policies.
- After the transfer is approved and notarized transfer documents are completed with the new Vendor/Seller, the remaining escrowed funds will be released to that Vendor/Seller, minus applicable fees.
25. Off-Platform Transactions & Referral Fee Obligations
To protect the integrity of the Us After Death Marketplace and ensure fair compensation for lead generation, the following rules apply to any connection, introduction, or sale that originates from the Platform.
- Originating Lead Source: If a Buyer and Seller first connect, communicate, or become aware of one another through Us After Death (including listings, messages, referrals, search results, introductions, or other Platform tools), the Platform is deemed the originating lead source for that connection.
- Prohibition on Circumvention: Sellers and Vendors must not (and may not encourage Buyers to) complete, attempt to complete, or otherwise facilitate any transaction outside the Platform for the purpose of avoiding commissions, fees, escrow, or other Platform charges.
- Referral/Commission Obligation: Where a transaction results from an originating lead, the Seller remains obligated to pay Us After Death the applicable commission or referral fee under the Seller’s rate plan (see Section 22 — Official Seller Plan). This obligation applies regardless of whether the final payment is made on or off the Platform.
- Invoicing & Payment: Us After Death will issue an invoice for any commission or referral fee owed for off-Platform transactions discovered or reported. Sellers must pay such invoices within 10 calendar days of issuance. Overdue invoices may incur administrative late fees and collection costs.
- Platform Remedies & Recovery: If a Seller fails to pay any invoice for commissions or referral fees, Us After Death may, in its discretion, pursue one or more of the following remedies:
- Suspend or terminate the Seller’s account;
- Withhold or offset any future payouts or credits due to the Seller;
- Charge the Seller’s payment method on file (to the extent permitted by law and the Platform’s payment agreements);
- Engage collection services or pursue legal action to recover unpaid amounts, including associated costs, interest, and attorneys’ fees.
- Duty to Report: Sellers must promptly notify Us After Death Support if a Buyer they met via the Platform completes any part of a transaction outside the Platform. Failure to report an off-Platform sale will be treated as a breach of these Terms and may result in additional penalties.
- Prohibition on Soliciting Alternate Payment: Sellers may not ask Buyers to pay off-Platform, provide alternate payment instructions, or otherwise solicit payment methods that circumvent Platform escrow and fee collection.
- Continued Liability: Account closure, deletion, or deactivation does not absolve a Seller of obligations to pay commissions or referral fees for transactions that originated via the Platform. Us After Death may pursue recovery against former account holders for amounts owed.
- Verification Rights: Us After Death reserves the right to investigate suspected off-Platform transactions, request supporting documentation from Sellers or Buyers, and determine whether a referral fee is owed. Sellers must cooperate with such investigations.
- Dispute Resolution: Any disputes regarding the applicability or amount of a referral fee must be submitted in writing to support@usafterdeath.com. Us After Death’s determination following its investigation will be binding pending any legal rights or remedies under applicable law.
By listing or responding to leads on the Us After Death Platform, Sellers and Vendors acknowledge and agree that the Platform must be compensated for connections it generates and that these obligations survive the completion of the transaction and/or account closure.
26. Sales Tax, Pricing, and Marketplace Fee Structure
Burial plots, mausoleum crypts, and columbarium niches listed on the Us After Death
Marketplace are treated as rights in real property. Under current U.S. state tax laws,
the sale of real-property burial rights is not subject to sales tax in any of the 50
states. As a result, the Marketplace does not collect sales tax on these qualifying
items.
This tax exemption applies only to the transfer of burial rights as defined above.
Vendors may also offer physical goods or services (such as urns, markers, vaults, or
installation services), which may be subject to applicable state and local taxes.
Any required taxes on taxable goods or services will be calculated and collected at
checkout in accordance with the purchaser’s jurisdiction.
Buyers and sellers are responsible for ensuring that their use of the Platform complies
with all applicable federal, state, and local tax laws. Us After Death does not provide
tax, legal, or accounting advice. Users should consult a qualified tax professional with
any questions regarding their specific obligations.
26.1 Vendor Responsibility for Sales Tax
Us After Death is a marketplace platform and is not the seller of record for any
items or services listed by Vendors. Vendors are solely responsible for determining whether any
portion of their listing is subject to sales tax under federal, state, or local law. If sales tax
applies, the Vendor must include the required tax amount within the final price
presented to the Buyer.
Us After Death does not calculate, collect, withhold, or remit sales tax on behalf
of Vendors. Vendors agree to collect and remit all applicable taxes directly to the appropriate
taxing authorities. Us After Death is not liable for any Vendor tax errors, omissions,
underpayment, or non-compliance.
26.2 Non-Taxable Real Property Transactions
Burial plots, mausoleum crypts, and columbarium niches listed on the Us After Death Marketplace
are treated as rights in real property. As such, these items are generally
not subject to sales tax in U.S. jurisdictions. Vendors must not apply sales tax
to these items unless required under specific local regulations that apply to their transaction.
26.3 Marketplace Service Fee Applied to Final Transaction Amount
Us After Death charges an 18% service fee on the total amount paid by the
Buyer, including (if applicable) any taxes, additional items, or fees included by the
Vendor in the final purchase price.
Because Us After Death does not calculate or allocate tax amounts, all fees are assessed based on
the gross transaction total that enters escrow. Vendors acknowledge and agree
that the Us After Death service fee is applied after the Vendor’s
tax-inclusive price is submitted.
26.4 Vendor Responsibility for Reporting and Compliance
Vendors agree to maintain accurate records, comply with all tax laws, and remit any required taxes
to the appropriate authorities. Us After Death bears no responsibility for tracking, validating,
or reporting Vendor taxes. Vendors understand that any failure to comply with tax laws may result
in account suspension or removal from the platform.
26.5 Transparency of Pricing
Vendors must clearly state the total price for the Buyer, inclusive of any
applicable taxes or add-on items, prior to purchase. Us After Death is not responsible for
disputes arising from tax charges or unclear pricing set by Vendors.
To ensure the security of every transaction and protect the rights of Legal Owners, Us After Death (operated by Delivery Team USA LLC dba Us After Death) recognizes two distinct tracks for Sellers who are listing property they do not personally own.
