Us After Death – Terms & Conditions

1. Marketplace Role

Us After Death is a platform connecting buyers and sellers. We do not act as a broker, agent, or legal representative. All users are responsible for complying with state, local, and federal laws regarding the sale, transfer, and purchase of memorial spaces or items.

2. Eligibility

Users must be 18 years or older to register and use the platform.By signing up, you confirm you have the legal capacity to enter into contracts.

3. User Accounts

All users must create a valid account with accurate information.Users are responsible for maintaining account security and for all activity conducted through their account.Sharing accounts is prohibited.

4. Buyer Responsibilities

Due Diligence: Buyers are responsible for reviewing all listing details and documents before submitting a purchase request.Accuracy of Information: Buyers must provide accurate personal information when creating an account and completing forms.Compliance: Buyers must comply with all local, state, and federal laws regarding the purchase and ownership of memorial spaces or items.Escrow Understanding: Buyers acknowledge that payment will remain in escrow until notarized transfer documents are signed.Timely Communication: Buyers should respond promptly to messages from sellers and the platform to keep transactions moving smoothly.Final Decision: Buyers acknowledge that all sales are final once the notarized transfer/ownership documents are signed.Platform Use: Buyers must communicate only through the Us After Death platform and not attempt to bypass escrow or make outside arrangements.

5. Seller Responsibilities

Accurate Listings: Sellers must provide complete and accurate information for each listing, including ownership documentation, location, and details about the memorial space or item.Proof of Ownership: Sellers are required to submit proof of ownership as part of the Seller Listing Registration Form before a listing can be published.Notary Documents: Sellers must complete all necessary transfer documents for the notarization process.Pricing: Sellers may set their own price, but must ensure it is fair and accurate. Top-performing listings often price memorial spaces around 20% below retail.Communication: Sellers must communicate exclusively through the platform and respond to buyer inquiries promptly (within one business day) to maintain engagement.Compliance: Sellers are responsible for following all state, local, and federal laws related to the sale of memorial spaces or items.Escrow & Payment: Sellers acknowledge that payment will be held in escrow until notarized transfer documents are signed, and they are responsible for contacting Stripe if payment issues arise.Final Sales: Sellers acknowledge that all sales are final once the notarized transfer agreement is signed.Prohibited Actions: Sellers must not attempt to bypass the platform, complete sales outside Us After Death, or engage in fraudulent or misleading activities. Violations may result in a $10,000 fine and/or account suspension.Ongoing Responsibility: Sellers should update the status of their listings every 7 days to ensure information remains current and accurate for buyers.

6. Listing Verification

Submission Review: All listings submitted by sellers are reviewed by Us After Death before they are published. This includes verifying ownership, listing details, and any documentation required to ensure accuracy and legitimacy.Proof of Ownership: Sellers must provide valid ownership documents during the registration process. Listings cannot be published without verification of ownership.Accuracy of Information: Listings must include accurate information regarding location, type of space, and any relevant details. Misrepresentation may result in removal of the listing or account suspension.Public Listing Approval: Once verified, listings are approved and made public for buyers to browse. Approval confirms that the listing meets platform standards and legal requirements.Ongoing Updates: Sellers are responsible for updating their listings every 7 days to ensure availability and accuracy. Outdated or incorrect listings may be removed from the platform.Platform Oversight: Us After Death reserves the right to reject, remove, or suspend listings at any time if they are found to be fraudulent, incomplete, or non-compliant with platform rules or applicable laws.Buyer Confidence: Verification ensures that buyers can trust the listings they see and that all spaces and items are legitimately represented.

7. Platform Use & Communication

Exclusive Communication: Buyers and sellers must communicate exclusively within the Us After Death platform. This ensures all conversations are secure, traceable, and protected.Timely Responses: Users are encouraged to respond to messages within one business day to maintain engagement and ensure smooth transactions.Support Response: Us After Death Support will respond to inquiries within two business days. Users should allow this time for responses before following up.Prohibited Communication: Sharing personal contact information to communicate outside the platform for a transaction is strictly prohibited.Harassment & Respect: Harassment, threats, abusive language, or any inappropriate behavior toward other users or Us After Death staff is strictly prohibited. Violations may result in account suspension, termination, or fines, depending on severity.Reporting: Users are encouraged to report harassment or inappropriate behavior via the platform messaging system or support@usafterdeath.com.

8. Payments

Escrow: Buyer payments are held in escrow until notarized transfer documents are signed, protecting both parties during the transaction.Payment Release: Once notarization is complete, the seller’s payment is released to their Stripe account within one business day.Outside Payment: Users are strictly prohibited from completing payments outside the platform. Us After Death is not responsible for transactions conducted off-platform, including lost or fraudulent payments.Payment Issues: Sellers should contact Stripe directly if any issues arise with receiving funds after notarization.

9. Notary Meetings

Free Access: Notary meetings are provided free of charge for both buyers and sellers.Document Preparation: All required transfer documents are prepared by Us After Death and provided to the notary ahead of time.Finalization: Completion of the notary meeting finalizes the sale. Both buyer and seller are legally bound by the signed documents.Availability: Notaries are available 24/7 to accommodate scheduling needs.

10. Gift Cards

Gift cards may be emailed directly to a recipient or saved for later use.Non-Refundable: All gift card purchases are final and non-refundable.Gift cards may only be redeemed on the Us After Death platform.

11. Prohibited Activities

Outside Sales: Completing a sale outside the Us After Death platform will result in a $10,000 fine and may lead to account suspension.Fraud & Misrepresentation: Misleading or false representations of listings, ownership, or identity are prohibited.Confidentiality: Users may not share private platform information, including other users’ contact details or transaction data.Platform Disruption: Any action that disrupts or interferes with the platform, including software misuse, hacking, or introducing viruses, is prohibited.Legal Compliance: Users must comply with all applicable local, state, and federal laws when using the platform.

12. Intellectual Property

All content on the platform, including text, images, logos, software, and designs, is the property of Us After Death or its licensors.Users may not copy, modify, distribute, or create derivative works from platform content without written permission.Unauthorized use of intellectual property may result in legal action.

13. Termination

Us After Death may suspend or terminate accounts for violations of these terms, illegal activity, or suspected fraud.Users may close their accounts at any time by contacting support.Termination does not relieve users of obligations for transactions already completed or in process, including fines or legal responsibilities.

14. Disclaimers & Limitation of Liability

The platform is provided “as is” and “as available” without warranties of any kind.Us After Death does not guarantee the accuracy of listings, availability of items, or successful transactions.Users agree that Us After Death is not liable for any losses, damages, or disputes arising from transactions, communications, or use of the platform.Users acknowledge that they are responsible for their own due diligence in all transactions.

15. Governing Law

These terms are governed by the laws of the state in which Us After Death is incorporated, without regard to conflict of law principles.Users agree to resolve disputes through binding arbitration where permitted by law.Users waive the right to class-action lawsuits against the platform.

16. Updates to Terms

Us After Death may update these terms at any time to reflect changes in policies, laws, or platform operations.Users will be notified of material changes via email or platform notification.Users are responsible for reviewing and complying with updated terms.

17. Support & Contact

For questions about the platform, listings, payments, or transfers, users may email support@usafterdeath.com.Support will respond within two business days, unless additional time is required, in which case users will be notified.Users should provide complete details when contacting support to ensure timely assistance.

18. User Acknowledgment

By using Us After Death, users acknowledge that:They understand all sales are final after notarized transfer.Payments will remain in escrow until notarization.They will not communicate outside the platform regarding listings or sales.Violations of platform rules, including outside sales, may result in fines or account termination.They are responsible for complying with all applicable laws and conducting due diligence before completing transactions.
